महाराष्ट्र शासनाने केंद्रीय अधिनियमांन्वये तयार केलेले

अधिसूचना

भारताचे संविधान,

क्रमांक कृषि आ-१६१२/प्र. क्र. १९९/१६-ए- भारतीय संविधानाच्या अनुच्छेद ३०९ च्या परंतुकाद्वारे प्रदान करण्यात आलेल्या अधिकारांचा बापर करून व याबाबतीत करण्यात आलेले सर्व विद्यमान नियम, आदेश किंवा विलेख यांचे अधिक्रमण करून, महाराष्ट्राचे राज्यपाल, याद्वारे, महाराष्ट्र शासनाच्या कृषि, पशुसंवर्धन, दुग्धव्यवसाय विकास व मत्स्यव्यवसाय विभागाच्या अंतर्गत असणाऱ्या कृषि आयुक्तालयामधील कृषि सहायक (गट-क) या पदाचे सेवा प्रवेशाचे विनियमन करणारे पुढील नियम करीत आहेत :

१. या नियमांना, कृषि, पशुसंवर्धन, दुग्धव्यवसाय विकास व मत्स्यव्यवसाय विभागाच्या अंतर्गत असणाऱ्या कृषि आयुक्तालयामधील कृषि सहायक (गट-क) (सेवाप्रवेश) नियम, २०१८, असे म्हणावे.

२. व्याख्या.– (१) या नियमात संदर्भानुसार दूसरा अर्थ अभिप्रेत नसेल तर.

(क) “प्रशासकीय विभाग” याचा अर्थ कृषि, पशुसंवर्धन, दुग्धव्यवसाय विकास व मत्स्यव्यवसाय विभाग, असा आहे।

(ख) “कृषि पदविका” याचा अर्थ सांविधिक विद्यापीठाची किंवा मंडळाची कृषि मधील पदविका किंवा शासनाने त्याच्याशी समतुल्य म्हणून घोषित केलेली अन्य कोणतीही अर्हता, असा आहे

(ग) “नियुक्ती प्राधिकारी” याचा अर्थ, शासनाने वेळोवेळी घोषित केलेला नियुक्ती प्राधिकारी, असा आहे

(घ) “आयुक्तालय” याचा अर्थ, कृषि आयुक्तालय, असा आहे

(ङ) “शासन” याचा अर्थ, महाराष्ट्र शासन, असाआहे

३. कृषि आयुक्तालयातील कृषि सहायक (गट-क) या पदावरील नियुक्ती एकतर-

(एक) रोगमळा मदतनीस (माळी) हे पद धारण करणाऱ्या व या गट-ड पदावर पाच वर्षांहून कमी नसेल इतकी नियमित सेवा पूर्ण केलेल्या आणि खंड (ख) च्या उपखंड (दोन) मध्ये नमूद केलेली अहंता धारण करणाऱ्या:

(दोन) रोपमळा मदतनीस (माळी), वगळून गट-ड चे कोणतेही पद धारण करणाच्या पदावरील पाच वर्षांहून कमी नसेल इतको नियमित सेवा पूर्ण केलेल्या व खंड (ख) च्या उपखंड (दोन) मध्ये नमूद केलेली अर्हता धारण करणाऱ्या

आणि

(तीन) कृषि आयुक्तालयाच्या प्रशासकीय नियंत्रणाखालील कार्यालयात गट “क” मधील कनिष्ठ लिपिक हे पद धारण करणाऱ्या त्या पदावर पाच वर्षांहून कमी नसेल इतकी नियमित सेवा केलेल्या आणि ज्यांनी खंड (ख) च्या उपखंड (दोन) मध्ये नमूद केलेली ता

धारण करणाऱ्या,

व्यक्तींमधून योग्यतच्या अधीनतेने, सेवा ज्येष्ठतेच्या आधारावर योग्य व्यक्तीला पदोन्नती देऊनः किंवा

(ख) (एक) सर्वसाधारण प्रवर्गातील व्यक्तींच्या बाबतीत, जिचे वय १९ वर्षापेक्षा कमी नाही व २८ वर्षापेक्षा अधिक नाही, आणि राखीव

प्रवर्गातील व्यक्तींच्या बाबतीत जिचे वय ४३ वर्षापेक्षा अधिक नाही आणि

(दोन) जिने कृषि विषयामधील पदविका धारण केलेली आहे किंवा शासनाने मान्यता दिलेली कृषि पदविकेशी समतुल्य असलेली कोणतीही अर्हता धारण करणाऱ्या,व्यक्तींमधून नामनिर्देशनाद्वारे करण्यात येईल.

4) कृषि सहायक पदावरील नियुक्ती, अनुक्रमे पदोन्नतीने व नामनिर्देशनाने १०:१० या प्रमाणात करण्यात येईल,

परंतु रोपमळा मदतनीस (माळी), रोपमळा मदतनीस (माळी) चगळून गट “ड” ची अन्य पदे व कनिष्ठ लिपिक यामधून कृषि सहायक

पदावरील नियुक्ती अनुक्रमे ३.५:५१.५ या प्रमाणात करण्यात येईल.

परंतु, आणखी असे की, पदोन्नतीसाठी नमूद केलेली अर्हता धारण करणारे योग्य उमेदवार उपलब्ध झाले नाहीत तर, नियुक्ती प्राधिकाज्याला, पदोन्नतीने करावयाच्या नियुक्तीचे प्रमाणे शिथिल करता येईल आणि नामनिर्देशनाद्वारे उमेदवारांची नियुक्ती करता येईल.

५. सदर पदावर नियुक्त झालेल्या व्यक्तीला, याबाबतीत करण्यात आलेल्या नियमानुसार आवश्यक करण्यात आलेली विभागीय परीक्षा

जर तिने उत्तीर्ण केली नसेल किंवा उत्तीर्ण होण्यापासून तिला सूट मिळाली नसेल तर सदर परीक्षा उत्तीर्ण होणे आवश्यक असेल,

६ सदर पदावर नियुक्त झालेल्या व्यक्तीला हिंदी व मराठी भाषा परीक्षा त्याबाबतीत करण्यात आलेल्या नियमानुसार सदर परीक्षा जर तिने या अगोदरच उत्तीर्ण केलेल्या नसतील किंवा त्या परीक्षा उत्तीर्ण होण्यापासून तिला सूट मिळाली नसेल, तर त्याबाबतीत करण्यात आलेल्या नियमानुसार उत्तीर्ण करणे आवश्यक असेल.

७. सदर पदावर नेमणूक झालेली व्यक्ती, महाराष्ट्र शासनाच्या माहिती व तंत्रज्ञान संचालनालयाने वेळोवेळी विहित केल्याप्रमाणे संगणक हाताळण्याबाबतचे प्रमाणपत्र धारण करील.

८.सदर पदावर नियुक्त झालेली व्यक्ती, संबंधित विभागात कोठेही चदली केली जाण्यास पात्र असेल.

NOTIFICATION

No. Krushian-1613/C.R. 191/16-A.-In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all the existing rules, orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of Agriculture Assistant in Group ‘C’ in the Commissionerate of Agriculture under the Agriculture, Animal Husbandry, Dairy Development and Fisheries Department of the Government of Maharashtra, namely:

1. These rules may be called the Agriculture Assistant in Group ‘C’ in the Commissionerate of Agriculture under the Agriculture, Animal Husbandry, Dairy Development and Fisheries Department (Recruitment) Rules, 2018.
2. Definitions.- (1) In these rules, unless the context otherwise requires,
3. (a) “Administrative Department” means the Agriculture, Animal Husbandry, Dairy Development and Fisheries Department;
4. b)”Agriculture Diploma” means a Diploma in Agriculture of Statutory Board or University or any other qualification declared by the Government to be equivalent thereto;
5. (c)”Appointing Authority” means Appointing Authority declared by the Government, from time to time;

(d) “Commisionerate” means the Commisionerate of Agriculture;

(e) “Government” means the Government of Maharashtra.

3. Appointment to the post of Agriculture Assistant in Group ‘C’ in the Commissionerate,

shall be made either. –

(a) by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons, holding the post of Nursery Assistant (Mali) Group ‘D’, having not less than

five years regular service on that post and possess qualifications mentioned in

sub-clause (ii) of clause (b);

(ii) holding any other post of Group ‘D’, excluding Nursery Assistant (Mali), having not less than five years regular service on that post and possess qualifications mentioned in sub-clause (ii) of clause (b); and

(iii) holding the post of Junior Clerk in the offices under the administrative control

of Commissionerate in Group ‘C’, having not less than five years regular service on that post and possess qualifications mention in sub-clause (ii) of clause (b); or (b) by nomination from amongst the persons, who,

(i) are not less than nineteen years of age and not more than thirty-eight years of

age, in case of persons belonging to general category, and not more than forty-three years of age, in case of persons belonging to reserved category; and

(ii) Possess a a Diploma in Agriculture or any other qualification recognized by the

Government to be equivalent thereto..

4.Appointment to the post of Agriculture Assistant shall be made by promotion and nomination in the ratio of 10: 90, respectively

Provided that, the appointment by promotion from the Nursery Assistant (Mali), other posts of Group D, excluding Nursery Assistant (Mali) and Junior Clerk shall be made in the ratio of 3.5 515 respectively Provided further that, if suitable candidates possessing qualification mentioned for promotion are not available, the Appointing Authority may relax the ratio for appointment by promotion and may appoint the candidates by nomination.

5. A person appointed to the post shall be required to pass the Departmental Examination. if required according to the rules made in that behalf, unless he has already passed, or has been exempted from passing that examination.
6. A person appointed to the post shall be required to pass the examinations in Hindi and Marathi languages according to the rules made in that behalf, unless he has already passed, or has been exempted from passing those examinations.
7. A person appointed to the post shall possess a Certificate in Computer Operations as

prescribed by the Directorate of Information Technology, Government of Maharashtra, from time

to time,

8. A person appointed to the post shall be liable to transfer anywhere in the respectivel Division.
